1. Agreement to Terms
By accessing or using AskMind services, you agree to be bound by these Terms and Conditions. If you disagree with any part of these terms, you may not access our services.
2. Services Provided
AskMind provides:
- Website Development: Upfront website build services with managed hosting terms (Quick Start from £799 upfront + £25/month; Starter and Professional are custom scoped — consultation required)
- QuickSites — Campaign Builds: Fast bespoke campaign websites available as code-only (self-hosted, one-time fee from £495) or AskMind-hosted (upfront + monthly from £495 + £29/month). Higher tiers available to purchase or book a consultation.
- Civics Platform: Community and council management platforms with AI integration
- AI Video Creation: Automated video production services
- Iris AI Chat: AI-powered customer service and knowledge base assistant
3. Subscription Terms
Website and platform subscriptions require a minimum 12-month commitment unless stated otherwise. Upfront plans include a 24-month hosting term to receive the discounted monthly rate. Services are billed monthly in advance. Prices are stated in GBP (£) and include VAT where applicable.
4. Payment & Billing
Payment is processed securely via our payment processor. By subscribing, you authorize AskMind to charge your payment method monthly. If a payment fails or is overdue by more than 3 days, AskMind may suspend public access, admin access, and AI video generation until the balance is resolved.
4A. Billing Start & Client Delays
The billing cycle and contract term begin on the Date of Signing or the initial payment date (whichever comes first), regardless of the go-live date. Delays caused by the Client (missing content, approvals, or feedback) do not pause billing.
4B. Fixed Price Guarantee
Your agreed hosting management fee is fixed for the duration of the initial contract term. AskMind will not increase the base fee during this period.
5. Ownership & Intellectual Property
You retain ownership of your content (text, images, video assets). All code, design assets, and platform infrastructure remain the sole property of AskMind until the Agreement ends and transfer conditions are met.
5.1 Retention of Title
During the contract term, the Client receives a revocable, non-exclusive licence to use the website while fees are paid and the account is in good standing.
5.2 Ownership Transfer (Contract Completion)
Ownership transfers to the Client after the contract term is completed and all agreed fees are paid in full. The Client may request a formal transfer via the Client Portal. No alternative buyout route applies.
5.3 QuickSites Campaign Builds (One-Time Purchase) Terms
QuickSites Campaign Build products (formerly referred to as Code Drop) are one-time purchases delivered via the Client Portal. AskMind builds a custom campaign website within the stated delivery window (typically 72 hours to 10 days) and provides the source code. Code-Only builds: the Client is responsible for self-hosting, configuration, and ongoing updates after delivery. AskMind-Hosted builds: include hosting on our Edge Network with a monthly hosting fee; the hosting subscription terms and 24-month minimum apply. Neither option includes ongoing maintenance, CRM, or security monitoring unless explicitly stated in the order.
6. Acceptable Use
You agree not to use our services for:
- Illegal activities or content that violates UK law
- Spam, phishing, or malicious software distribution
- Content that infringes third-party intellectual property
- Harassment, hate speech, or discriminatory content
6A. Content Management & AI Guardrails
Subscription plans may include access to a Pages Command Center or similar content management tools. While our AI Guardrails assist in maintaining compliance, layout integrity, and design standards, the Client accepts final responsibility for any content changes published via these tools.
AskMind provides AI-powered safeguards to prevent common errors (such as breaking layouts, publishing incomplete content, or violating accessibility standards), but these are advisory tools, not guarantees. You should review all changes before publishing.
6B. AI-Generated Content & Liability
The Client acknowledges that video and text content provided by AskMind may be generated by Artificial Intelligence. AskMind makes no warranties regarding the factual accuracy, originality, or copyright clearance of AI-generated outputs. The Client is responsible for reviewing and approving all AI content before publication.
7. Service Availability & Timelines
We aim for 99.9% uptime but cannot guarantee uninterrupted service. Scheduled maintenance will be communicated in advance where possible.
7A. Delivery Estimates & Billing Guarantee
Realistic Estimates: Our delivery timelines (e.g., 6-12 weeks for apps, 72 hours for simple sites) are realistic estimates based on our "Rapid Deploy" methodology. We take pride in meeting or beating these targets in 90% of projects.
Billing Pause Guarantee: If a project timeline exceeds our estimate due to a delay on our end (AskMind's fault), we will immediately pause your subscription billing until the work is complete. You only pay when we are actively delivering value.
"Go At Your Speed": For smaller website builds, the timeline often depends on how quickly you can provide content or feedback. If you need more time, that is perfectly fine. Subscription billing continues during this period to maintain your server reservation and project slot, but you are free to "Go At Your Speed" without pressure from us.
8. Limitation of Liability
AskMind is not liable for indirect, incidental, or consequential damages arising from service use. Our total liability is limited to the amount you paid in the previous 12 months.
9. Termination
You may cancel your subscription after the minimum term with 30 days notice. If an outstanding balance is not cleared within 30 days of the initial payment failure, the contract will be considered breached and AskMind may permanently delete client data, source code, and project files from the server. We may terminate your account immediately for material breach of these terms.
10. Governing Law
These terms are governed by the laws of England and Wales. Disputes will be resolved in UK courts.

- Payment Data: Processed by our payment processor (we don't store full card details)
- Usage Data: Pages visited, features used, session duration
- Content You Create: Text, images, videos uploaded to our platforms
2. How We Use Your Data
- Provide and improve our services
- Process payments and send invoices
- Send service updates and support communications
- Improve product quality using aggregated and/or anonymised insights where feasible

2A. Lawful Bases (UK GDPR)
We rely on one or more of the following lawful bases depending on context:
- Contract: to provide the services you request
- Legitimate interests: to operate, secure, and improve our services
- Legal obligation: for accounting and tax requirements
- Consent: where required (e.g., certain email marketing preferences)
3. Data Storage & Security
Your data is stored in Neon PostgreSQL databases hosted in EU/UK data centers. We use encryption at rest and in transit. Access is restricted to authorized personnel only.
4. Third-Party Services
We use:
- Payment Processor: Secure payment processing (PCI-DSS compliant)
- Netlify: Website hosting and CDN
- AI Providers: We may use third-party AI model APIs to deliver features. Where available, we use provider settings intended to limit use of customer data for training. Exact behaviour depends on the provider and configuration at the time.
4A. International Transfers
Some service providers may process data outside the UK. Where applicable, we aim to use appropriate safeguards (such as contractual protections) for international transfers.
5. Your Rights (GDPR)
You have the right to:
- Access your personal data
- Rectify inaccurate data
- Request deletion (subject to legal retention requirements)
- Export your data in a portable format
- Object to processing or withdraw consent

5A. Data Export vs. Code Export
Important Distinction:
📊 Data Export (Free - GDPR Right): Your business data including customer lists, orders, subscriptions, form submissions, and analytics. Provided in a portable file format within 48 hours of request. This is your legal right under GDPR.
💻 Code Export (Ownership Terms Apply): The website source code (React/Node/HTML/CSS/JavaScript). This is governed by Section 5 (Intellectual Property). Ownership transfer applies after contract completion and full payment of agreed fees.

6. Data Retention
We retain your data for the duration of your subscription plus 7 years for tax/accounting purposes. You can request early deletion after cancellation.
